Webb Ivory (Guernsey) Limited

Product codes prefixed with a G, are supplied by our wholly owned subsidiary company Webb Ivory (Guernsey) Ltd. Any mix of products may be ordered with only one P&P charge, as usual, with G coded products being fulfilled from Guernsey within our usual delivery promise. The following Terms and Conditions apply.

Terms and Conditions

All goods described as supplied by Guernsey on this website are supplied by Webb Ivory (Guernsey) Ltd, which will be the contracting party for any order that you place. Webb Ivory (Guernsey) Ltd is registered in Guernsey, registered office is 3rd Floor, Wolverton Place, Market Square, St Peter Port, Guernsey GY1 1HB. (The company's administrative office is PO Box 336, Anson Court, La Route des Camps, St Martin, Guernsey, GY1 3UQ and whose company registration No. is 47242 . "We, us" means Webb Ivory (Guernsey) Ltd.

These terms and conditions apply to all transactions for the sale of goods from Guernsey.

Orders

When you place an order this shall be an offer by you to purchase goods from us. We shall be under no obligation to accept such an offer.

Following your order we will send you an acknowledgement email. This acknowledgement is NOT an order confirmation or order acceptance from us but merely an acknowledgement that we have received your order.

Acceptance of your order and the completion of the contract between you and us will take place when we have sent you an email to confirm that your goods have been despatched, unless we have notified you that we do not accept your order or you have cancelled it.

We would recommend you print out these Terms & Conditions and the order acknowledgement for your own records.

For quality and training purposes, we may monitor communications.

Title and Risk

The sale of the goods takes place in Guernsey, ex-works. The title, ownership and risk of loss and/or damage in the goods shall pass to you at the point and time at which the goods are charged to your account.

Despatch

We will arrange for the despatch of your order on your behalf from our place of business in Guernsey unless you notify us in advance that you will arrange for the collection of your own goods from our premises.

Customs and VAT

You are the importer of goods which are despatched on your behalf to an address outside Guernsey. You are therefore responsible for complying with all laws and regulations of the country into which the goods are imported. The goods may be subject to import duties and taxes which are applied once the shipment reaches the destination country. Any such additional charges levied for customs clearance must be borne by you. You are responsible for these charges and for complying with all the laws and regulations of the appropriate Customs authorities.

It is acknowledged by you that Webb Ivory (Guernsey) Ltd has no control over any additional charges for customs clearance and cannot predict what these may be at any time in the future.

For orders valued at £18 and over and imported by you into the UK, we will through the VAT pre-payment scheme in Guernsey, arrange for VAT at 17.5% and any applicable customs duty due on your importation to be paid to HM Revenue and Customs. You should note that this procedure is for your convenience only and is specific for the importations you make into the UK. This arrangement does not change any of the relevant terms and conditions mentioned in this agreement and you may notify us at any time that you do not wish to take advantage of this administrative measure. Please note that you are and will remain the importer of all goods shipped to an address outside Guernsey and you will be solely responsible and liable for the payment of any import VAT, customs or other duty or other taxes, levies or tariffs chargeable on the stated goods.

Price and Payment

All Prices shown on the website for product supplied by Webb Ivory (Guernsey) Ltd are not subject to local VAT. Vat is payable in the UK by the importer of the goods. You are considered the importer of goods and must comply with all laws and regulations of the UK. If you have purchased products for delivery to the UK which have an intrinsic value of less than £18, you may be eligible for an exemption from VAT on importation of such products into the VAT territory of the UK. Current UK regulations on the importation of product specify that "low value" goods (with an intrinsic value of less than £18) are exempt from import VAT. However, these regulations could change.

Please note that we have no control over any additional charges for customs clearance and cannot predict what these may be at any time in the future. You are responsible for these charges and for complying with all laws and regulations of the UK Authorities, HM Revenue and Customs. Please refer to the section above titled " Customs & VAT".

Payment is taken once we have established that we can fulfill your order and checked details and stock availability. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible and we will where possible send substitute goods. In the event of such failure to supply goods or your return of substitute goods that you do not accept a full refund will be given where you have already paid for the goods. Items may be despatched separately to ensure an efficient delivery process, we may debit each item as a separate transaction on your credit/debit card. Charges to your credit/debit card will show as Webb Ivory (Guernsey) Ltd.

Prices are continually reviewed and may result in some prices showing differently on our Website to our catalogue.

The price you pay is the price displayed on this Website at the time we receive your order apart from the following exception. Whilst we try to ensure that all prices on our Website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Delivery and P&P

Products sold by Webb Ivory (Guernsey) Ltd are despatched from Guernsey to UK addresses only, unfortunately, we are unable to despatch to the Channel Islands. We charge £3.99 per order to UK addresses, irrespective of the number of items or number of deliveries. We aim to deliver within 7 working days, please allow a further 7 days before you query a non delivery.

Occasionally Suppliers delay release dates or delist titles temporarily or permanently without notice. We aim to provide weekly updates on delayed titles.

We will use reasonable endeavours to meet these estimated timescales however sometimes delays may occur. We shall not be liable to you for any such delay or failure to deliver the goods within these estimated timescales.

This applies to all our goods except DVDs, CDs, software, audio and video tapes where the item has been opened, self-assembly furniture once assembly is part or fully completed, personalised items and pierced earrings unless they are faulty. This is in addition to your statutory rights.

Returning Goods. Goods must be returned in mint condition, complete with all contents and packaging to Webb Ivory (Guernsey) Ltd, PO Box 508, Guernsey, GY1 6DR. Please note that you will be responsible for the costs of returning goods to us. If the goods are being returned because they are faulty or were delivered to you in error, we will reimburse your return postage costs. We would recommend for your own protection that you use a recorded delivery service.

Compatibility and Packaging

We are not responsible for ensuring product compatibility with your equipment's specification. We make no warranty that the goods will meet your individual requirements, it is your responsibility to ensure that the facilities and functions described are suitable for your purposes. We cannot guarantee you will receive packaging as illustrated as publishers often change packaging of goods.

Right to Cancel

Statutory rights

The Consumer Protection (Distance Selling) Regulations gives you the right to a 'cooling off' period, i.e. a right to cancel your order within 7 working days following the day of receipt of the goods and return them for a full refund. This applies to all our goods except audio, video and computer software where the item has been opened. It is your responsibility to give notice of your wish to cancel within this cancellation period by email, fax, letter or telephone. The goods must be returned in mint, saleable condition at your expense and we would recommend for your own protection that you use a recorded delivery service.

Amendments to our services and Terms & Conditions

We reserve the right to make changes to our Website, policies, and Terms & Conditions. Any changes will be posted on our Website. It is your responsibility to check whether the Terms & Conditions have been revised, as use of our site after the date of any revision notice shall be deemed to constitute your acceptance of the revised Terms & Conditions.

Each provision of these Terms & Conditions is severable from the others, and in the event that any provision is declared invalid or unenforceable, that provision shall be amended if possible to be enforceable, but in any event, the remaining provisions shall remain in effect.

Notwithstanding anything contained in these Terms & Conditions in the event of any obligation or obligations being partly or totally impossible of performance by us for any reason beyond our reasonable control (including but not limited to war, invasion, act of foreign enemy, hostilities whether war be declared or not, civil war or strife, rebellion, strikes, lock-outs or other industrial disputes or infrastructure failure, actions, acts of God, acts of government or defaults of third parties) then such non-performance shall not be a breach of these Terms & Conditions.

These Terms & Conditions and the Privacy Policy are a complete and exclusive statement of the understanding between us and supersede all prior agreements and representations between us, relating to the subject matter of these Terms & Conditions.

You hereby agree that the provisions of the Contracts (Rights of Third Parties) Act 1998 are expressly excluded from these Terms & Conditions so that no rights are conferred on any third parties by these Terms & Conditions.
